Terms of Service

The agreement between you and Prostaff Partners Pvt Ltd when you use prostaff.app.

1. This agreement

These terms are an agreement between you and Prostaff Partners Pvt Ltd ("prostaff", "we", "us"), based in Malé, Republic of Maldives, for your use of prostaff.app and its services (the "platform"). By creating an account or using the platform you agree to them. If you use the platform for a business, you agree on behalf of that business and confirm you are authorised to.

Our Privacy Policy explains how we handle personal information and forms part of these terms. Agencies are also bound by the Agency Candidate Consent terms.

2. What prostaff is — and is not

prostaff is a marketplace that connects employers, employment agencies, job seekers, independent professionals and service firms in the Maldives. It lets employers post vacancies, workforce requests and projects; lets people apply, bid and be submitted as candidates; and records hires so both sides can confirm them.

We are not an employer, an employment agency or a party to any employment or service contract made through the platform. We do not guarantee that a vacancy will be filled, that an applicant is suitable, that a listing is accurate, or that anyone will pay what they agreed. You are responsible for your own checks, contracts, work permits, and compliance with employment, immigration and tax law.

3. Accounts

  • You must be at least 18 years old to create an account.
  • Choose the account type that matches what you are: an employer, an employment agency, a job seeker, an independent professional or a service firm. You may not change type to get around a restriction.
  • Give accurate information and keep it up to date. Businesses must use their real registered or trading name.
  • Keep your password private. You are responsible for activity on your account. Tell us straight away if you think someone else has used it.
  • One person or business, one account per account type, unless we agree otherwise.
  • Staff accounts (administrators and operators) are created by us only and must use two-factor sign-in.

4. Verification and badges

You may submit documents so our team can verify your identity or business. A verified badge shows only when verification is complete and your plan permits it; paying alone never grants it. Verification is a check at a point in time, not an endorsement or a guarantee, and we may withdraw it if information turns out to be false.

5. Who sees what

  • Job seeker profiles are shown only to employer accounts and our staff — not to other job seekers, agencies or the public.
  • Employer, agency and firm profiles are public showcases.
  • Phone numbers and WhatsApp numbers are never shown on a profile. An eligible account can unlock them, which uses its plan allowance and is recorded.
  • Messages can only be exchanged between people already connected by an application, bid, candidate submission or placement.

6. Your content and conduct

You keep ownership of what you post (profiles, listings, résumés, messages, ratings). You give us a non-exclusive, royalty-free licence to host, display, and process it as needed to run and promote the platform — for example, showing a public vacancy on the job board, in search engines and on social media. The licence ends when the content is deleted, except where we must keep records (see the Privacy Policy).

You must not:

  • post a vacancy, project or request that is fake, misleading, unlawful, discriminatory, or not genuinely open;
  • ask a job seeker to pay a fee to apply, to be hired, or for training or placement that is a condition of the job;
  • post content that is abusive, harassing, sexual, hateful, or that infringes someone else's rights;
  • use contact details, résumés or candidate information for anything other than the hiring or project they were shared for — including marketing, reselling or building your own database;
  • move a hire or project off the platform to avoid a commission that would otherwise be due;
  • leave ratings about people you have not dealt with, or ratings in exchange for anything;
  • scrape, harvest or bulk-download data, probe or disrupt the platform, get around rate limits, bot checks or plan limits, or access accounts or data that are not yours;
  • upload malware, or submit forged documents or payment slips.

7. Reports, moderation and suspension

Anyone can report an account, listing, message or rating. Our team reviews reports and may dismiss them, remove or hide content, unpublish a listing, or suspend an account. We keep removed content on record so decisions can be reviewed.

We may suspend or close an account that breaks these terms, puts others at risk, or is used for fraud, with or without notice where the risk justifies it. You can ask us to review a decision by writing to [email protected].

9. Placements and commission

When an employer hires an applicant, accepts an agency's candidate, or awards a project through the platform, a placement is recorded. The other side is asked to confirm it, or can dispute it; our team resolves disputes and may confirm a placement that is left unanswered.

When commission is in effect, the employer pays a commission on each confirmed placement:

  • for a job — a percentage of the first month's salary agreed for the hire;
  • for a project — a percentage of the accepted bid.

The rates, and any minimum or maximum, are those in effect when the invoice is issued and are available on request before you hire. An invoice is issued once the placement is confirmed and the start date has passed, and is due within 14 days. Invoices are paid by bank transfer in the same way as plans. Job seekers, professionals, firms and agencies are never charged commission by us on a placement.

If a confirmed hire is later withdrawn by agreement or found invalid, contact us: we may void the invoice or waive the commission. Avoiding commission by recording a hire off-platform after meeting through the platform is a breach of these terms, and we may invoice the commission that would have been due.

10. Agencies

Agencies may keep a pool of candidates and submit them to employers. An agency must have each candidate's informed consent before adding them, confirms that consent on the platform each time, and must follow the Agency Candidate Consent terms. The agency — not prostaff — is responsible for its relationship with its candidates.

11. Ratings

You can rate someone after a confirmed placement with them, or once you have exchanged messages. Ratings must be honest and based on your own dealings. We show who left a rating only to people allowed to see that person's profile. We may hide ratings that break these terms; we do not remove ratings just because they are negative.

12. Availability and changes to the platform

We work to keep the platform available and your data safe, but we do not promise uninterrupted service. We may change, add or remove features. If we remove a paid feature during a period you have paid for, we will offer a fair adjustment.

13. Disclaimers and liability

The platform is provided "as is". To the extent the law allows, we are not liable for: the conduct of other users; the outcome of any hire, project or payment between users; loss of profit, business or opportunity; or indirect or consequential loss.

To the extent the law allows, our total liability to you for any claim relating to the platform is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud.

You agree to cover our reasonable losses caused by your breach of these terms or your unlawful use of the platform, including claims by people whose information you uploaded.

14. Ending your account

You can stop using the platform at any time and ask us to close your account by writing to [email protected] from your account's email address. Unpaid invoices remain payable after closure. Sections that by their nature should continue — such as payment obligations, licences needed to keep records, liability and governing law — continue after the account ends.

15. Changes to these terms

We may update these terms. For a significant change we will tell you by email or in the platform at least 14 days before it takes effect, unless the change is required sooner by law or to deal with misuse. Continuing to use the platform after that means you accept the new terms; if you do not, you can close your account.

16. Governing law and disputes

These terms are governed by the laws of the Republic of Maldives. We will try to resolve any dispute informally first — write to us. If that fails, the courts of the Maldives have jurisdiction.
