Agency Candidate Consent
What an employment agency must do before adding a candidate to prostaff or submitting them to an employer.

1. Why this exists
Agencies can add candidates who do not have their own prostaff account, and send their details to employers. That is someone else's personal information. These terms apply to every agency account in addition to the Terms of Service, and each time you add a candidate you confirm you have followed them.
2. Consent you must have first
Before adding a person to your candidate pool, you must have their informed, freely given consent — in writing or another form you can show us later — to:
- you holding their details on prostaff;
- you sending their details (including their CV and contact information you upload) to employers on prostaff for roles they are interested in;
- prostaff storing and processing that information to provide the service, as described in our Privacy Policy.
Tell the candidate who you are, that you use prostaff, which kinds of employers or roles you will put them forward for, and how to ask you to remove them.
3. Accuracy and honesty
- Only upload information the candidate gave you or agreed you could use, and keep it accurate and current.
- Do not submit a candidate for a role they have not agreed to be put forward for.
- Do not alter qualifications, experience, documents or identity details.
- Do not charge candidates fees that the law prohibits, and never make payment by a candidate a condition of submitting them.
4. When a candidate withdraws consent
If a candidate asks you to stop, remove them from your pool promptly and do not submit them again. Submissions already sent stay on record with the employer they were sent to, as part of that hiring process.
5. Records and requests
Keep evidence of each candidate's consent for as long as you hold their details on prostaff and for a reasonable time afterwards. If we ask — for example after a complaint — you must show it to us. If a candidate contacts us, we may share their request with you and may remove their information ourselves.
6. Responsibility
You are responsible for the candidate information you upload and for your relationship with your candidates. If you add or submit someone without consent, we may remove the information, suspend your account, and you agree to cover losses and claims that result, as set out in the Terms of Service.
